Terms of Service

1. Services

Waukee Aerial LLC (“Waukee Aerial,” “we,” or “us”) provides recurring aerial drone documentation services for commercial construction sites, including orthomosaic mapping, progress photography, progress video, and 360° panoramas. All services are performed by FAA Part 107 licensed pilots.

2. Scheduling and Minimum Commitment

Recurring documentation programs require a minimum of four (4) scheduled visits. Visit frequency (weekly, bi-weekly, or milestone-based) is agreed upon at program setup. Schedule changes require at least 48 hours notice. We reserve the right to reschedule visits due to weather conditions, airspace restrictions, or other operational factors beyond our control.

3. Payment Terms

Programs are billed monthly based on visits completed. Payment is due within 15 days of invoice. Late payments may result in service suspension. On-demand and hourly services are billed upon completion.

4. Cancellation

Either party may cancel a recurring program with 14 days written notice after the minimum 4-visit commitment is met. Early cancellation before the minimum commitment may result in a cancellation fee equal to the remaining visits at the contracted rate.

5. Intellectual Property

Upon full payment, the client receives full license to use all deliverables (maps, photos, video, panoramas) for their intended commercial purposes. Waukee Aerial retains the right to use non-confidential imagery in its portfolio and marketing materials unless the client requests otherwise in writing.

6. Insurance and Liability

Waukee Aerial carries commercial drone liability insurance. Our liability is limited to the value of services rendered. We are not liable for project delays, third-party decisions, or consequential damages arising from the use of our deliverables.

7. Force Majeure

Weather cancellations, temporary flight restrictions (TFRs), mechanical issues, or other conditions beyond our control do not constitute a breach of contract. We will reschedule affected visits at no additional charge.

8. Governing Law

These terms are governed by the laws of the State of Iowa. Any disputes shall be resolved in Dallas County, Iowa.
